Preamble:
This agreement sets out the terms and conditions governing the use of hosting services provided by Syria Cloud, a company offering cloud and website hosting solutions. By using these services, you agree to comply with all the provisions set forth below, in accordance with German (GDPR, Telemedia Act - TMG, Digital Services Act - DSA) and EU laws.
1. Definitions:
- Syria Cloud: The hosting service provider responsible for operating cloud infrastructure in compliance with German and European laws.
- User: Any individual or entity utilizing Syria Cloud’s hosting services.
- Content: Any data, information, files, or applications uploaded or stored on Syria Cloud’s servers.
2. Scope of Service:
Syria Cloud provides hosting services as agreed, including:
- Website and application hosting.
- Data storage and management in compliance with GDPR regulations.
- Security and protection following the best industry standards.
- Technical support within the agreed service scope.
3. Responsibilities and Obligations:
3.1 Syria Cloud’s Obligations:
- Provide a secure and compliant hosting environment in line with German and EU laws.
- Offer technical support according to agreed terms.
- Ensure compliance with GDPR regarding data storage and processing.
- Maintain security logs in accordance with Telemedia Act (TMG) and Digital Services Act (DSA).
3.2 User Obligations:
- Use the service lawfully and in compliance with German and international laws.
- Keep login credentials confidential and do not share them with third parties.
- Comply with GDPR when handling personal data of end users.
- Take full responsibility for all uploaded content.
4. Prohibited Activities (Legal and Technical):
4.1 Legal Prohibitions:
Users may not use the hosting services for:
- Storing or distributing illegal content, including child exploitation materials, hate speech, or incitement to violence, in accordance with the Network Enforcement Act (NetzDG).
- Hosting services that violate Telemedia Act (TMG) or Digital Services Act (DSA).
- Engaging in hacking, cyberattacks, or distributing malware.
- Violating intellectual property rights or hosting pirated content.
- Breaching German and EU consumer protection laws.
4.2 Technical Prohibitions:
- Excessive resource consumption that negatively affects server performance.
- Sending spam emails in violation of EU anti-spam laws.
- Running scripts or applications that cause excessive server load.
- Hosting cryptocurrency mining operations without explicit permission from Syria Cloud.
- Attempting to breach or manipulate server security systems.
5. Privacy Policy & GDPR Compliance:
- Syria Cloud processes user data in compliance with the General Data Protection Regulation (GDPR).
- User data is not shared with third parties unless required by a legal request from EU authorities.
- Users may request permanent deletion of their data in line with GDPR regulations.
- Users must not collect or process end-user data unlawfully.
- All stored data is encrypted and protected in accordance with ISO 27001 security standards.
6. Service Suspension & Termination:
Syria Cloud reserves the right to suspend or terminate service in the following cases:
- Violation of any provisions in this agreement.
- Illegal or unethical use of services.
- Non-payment of due fees, if applicable.
- Security threats affecting server integrity or other users.
- Any violation of Telemedia Act (TMG) or Digital Services Act (DSA).
Upon termination, the user may request a copy of their data within 30 days, except in cases where legal authorities require its deletion.
7. Changes to the Agreement:
Syria Cloud reserves the right to modify this agreement at any time. Significant changes will be communicated via email or the official website. Continued use of the service after modifications implies acceptance of the new terms.
8. Governing Law & Dispute Resolution:
- This agreement is governed by the laws of the Federal Republic of Germany and EU regulations.
- Any disputes shall first be resolved amicably. If unresolved, they fall under the jurisdiction of German courts.
- Users may contact the German Data Protection Authority (BfDI) for GDPR-related concerns.
9. Customer’s Right of Withdrawal as a Consumer
Right of Withdrawal for Consumers
Consumers have the right to withdraw from this contract under the following conditions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.

You have the right to withdraw from this contract within fourteen days without stating any reason.
The withdrawal period is fourteen days from the date of contract conclusion.

by means of a clear declaration (e.g., a letter sent by post, fax, or email) stating your decision to withdraw from this contract. You may use the attached model withdrawal form, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient to send your communication concerning your exercise of the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery we offer), promptly and no later than fourteen days from the day we receive your notice of withdrawal from this contract. We will make the refund using the same payment method you used for the original transaction, unless expressly agreed otherwise with you; in any case, no fees will be charged for this refund.
If you requested that the services begin during the withdrawal period, you must pay us an appropriate amount corresponding to the proportion of services already provided up to the point at which you notified us of the withdrawal, relative to the total scope of services agreed in the contract.

13. Agreement Acceptance:
By using Syria Cloud services, the user acknowledges having read and understood all terms and agrees to comply with them.
